Notification to Welsh Ministers: Non Inclusion of Social Public Works Clauses or Absence of an Implementation Process
This form is for Welsh Contracting Authorities that are required to comply with Section 29 (Social Public Works Clauses: notifying the Welsh Ministers) of the Social Partnership & Public Procurement (Wales) Act 2023 (“the Act”).
Under the Act, Contracting Authorities must either include the relevant model clauses in major construction contracts (i.e. a works contract with an estimated value above £2 million), or notify Welsh Ministers when they cannot be included or implemented.
When you should submit this notification
You must complete this form if any of the following apply to an outsourcing services contract:
- You do not intend to include one or more of the model clauses;
- You have awarded or entered into a contract without including one or more of the model clauses;
- You do not have a process in place to ensure the obligations within the clauses are implemented, including (where relevant) in supply chains or subcontracted arrangements.
